Reminger Obtains Unanimous Defense Verdict in Favor of Nursing and Rehab Center
Reminger Attorneys Melvin Davis, Thomas Prislipsky, and Kenton Steele obtained an 8-0 defense verdict in favor of a nursing and rehabilitation center. The decedent was afflicted with Oculopharyngeal Muscular Dystrophy (OPMD), a rare disease that affects as few as 5,000 people in the U.S. Plaintiff alleged that the nurses at the nursing and rehab center were not familiar with OPMD and failed to appreciate the increased risks of respiratory complications and, as a result, the decedent expired due to mucus plugging and pneumonia.
Plaintiff’s counsel requested the jury to return a verdict for nearly $40M. The jury rejected the request and returned a verdict finding that the nurses met the standard of care. Specifically, the jury found that the nurses followed the nurse practitioner’s orders and kept the nurse practitioner informed of significant changes in the decedent’s condition.
