Digital evidence exists on every device and platform that we use on a daily basis. Mobile devices and computers contain electronically stored information (ESI) that can provide evidence necessary to win your case. Social media, emails, instant messages, internet browser history, and GPS tracking history leave a digital fingerprint that may significantly impact the outcome of litigation. It is rare to find a legal matter nowadays that does not include a component of ESI.

This seminar focuses on how to locate, discover, and preserve ESI, and provides insights on current technologies and what they mean to litigation today.

PANELIST: BRIAN NALLY, Reminger Co., LPA, E-Discovery Practice Group Chair

Brian is a Partner practicing out of Reminger’s Cleveland and Indianapolis offices. He serves as Chair of the firm’s Electronic Discovery Practice Group, which addresses the preservation, collection, and production of electronically stored information (ESI). Brian oversees a team of seasoned litigators who understand the legal and strategic issues related to ESI, and who stay abreast of changing standards pertaining to this niche realm of law.

PANELIST: MICHAEL MCCARTNEY, Avalon, President of Cyber

Mike is President of Avalon Cyber and is a 22-year veteran member of the law enforcement community, having served as an Assistant Chief Investigator for the New York State Attorney General’s Office (NYSAG) as well as five years with the United States Attorney’s Office (USAO) for the Western District of New York. One of the original founders of the Western New York Regional Computer Forensic Lab, Mike authored the original policies and procedures for evidence handling and processing. Mike also established several covert and undercover electronic evidence collection procedures which are still used as the standard today by law enforcement.

Scott has over 15 years of litigation-support experience and currently consults with law firms and corporate legal teams on their eDiscovery & cloud-based needs. His areas of expertise include cyber security, data collection, early case assessment, data processing, and hosted review platforms. Scott is a Certified E-Discovery Specialist, a Relativity Certified Sales Professional, and a Relativity Review Specialist.

PANELIST: Judge Brendan J. Sheehan, Cuyahoga County Court of Common Pleas
Brendan has been a Judge on the Cuyahoga County Court of Common Pleas since 2009. He practiced as a civil and criminal litigator for 14 years prior to assuming the bench. As a prosecutor in the Major Trial Division of the Cuyahoga County Prosecutor's Office, Brendan served as Chairman of the Ohio Internet Crimes Against Children Taskforce and the Chairman of the Legal Committee for the National Internet Crimes Against Children Taskforce. He instructed law enforcement officials across the country on the investigation and prosecution of internet crimes.
