The workplace has evolved into a complex arena, fraught with regulatory and litigation-based challenges that can put any business at risk and threaten its very existence. In addition, employment law is a rapidly evolving area which requires the skill of a qualified advocate and counselor to navigate. Fast-paced changes come in the form of ever-evolving EEOC guidance, paradigm shifts in the law and the way we view employment relationships, and the growing importance of Human Resources departments. Our employment defense attorneys handle not only regulatory matters and lawsuits, but also offer expert advice to help employers avoid litigation.

Working with insurers, their insureds and self-insured companies, Reminger Co., LPA attorneys handle a large volume of matters that cover the full spectrum of employment claims, including: 

  • Age Discrimination in Employment Act
  • Title VII claims, including sex, race, national origin and religious discrimination
  • Civil rights claims, including Section 1981 and Section 1983
  • Americans with Disabilities Act (ADA) 
  • Family Medical Leave Act (FMLA)
  • Fair Labor Standards Act (FLSA)
  • ERISA Litigation
  • Common-law and statutory claims that the courts have recognized, such as claims for wrongful discharge in violation of public policy, violation of non-compete agreements, tortuous interference claims, and deceptive trade practices/trade secrets claims

Our attorneys routinely represent clients in regulatory investigations by the Equal Employment Opportunity Commission (EEOC), the Civil Rights Commission, the Department of Labor (DOL), and the Occupational Safety and Health Administration (OSHA).

Reminger prides ourselves on the fact that we have been at the forefront of developments in employment law, at times handling the very Supreme Court case that forms the law.  We vigorously defend claims in jury trials at both federal and state court levels.

While the primary focus of our Employment Practices Defense Group is representing employers in both pre-suit and active litigation, we are regularly involved in day-to-day consultation with company officers, human resources managers, and other representatives that have legal or risk management concerns. At Reminger, our employment lawyers are trained to consult with employers to manage risks before a claim or litigation ensues. We keep apprised of changes and trends in workplace law in order to advise our clients on best practices involving:

  • Wage and hour laws
  • Employee manuals and policy statements
  • Training manuals
  • Drug and alcohol testing policies
  • Sexual harassment training
  • ADA and FMLA (and other statutory) compliance issues
  • Background check policies and procedures
  • Other employment related topics

We are often called upon to guide employers through difficult terminations, severance packages, non-compete agreements, and drafting the ultimate release documents that, depending on the client's choice, can be the preventive medicine that wards off potential claims in varied employment contexts.

We regularly conduct complimentary seminars for clients to attend as our guests. These seminars often address cutting-edge issues and provide an annual update/refresher on the relevant issues confronting employers. Our employment lawyers frequently write and publish articles on trending employment topics. We publish a bi-annual Employment Practices Group Newsletter, as well as frequent Reminger Repots on trending issues or important court decisions as they arise. Samples of the types of training, publications and seminars we provide are available upon request.
