In re Guardianship of Soltesz, 6th Dist. Nos. E-13-067, E-13-072, 2014-Ohio-2832. After the decedent's guardianship ended with the probate court filing an entry to approve and settle the guardianship's account on May 30, 2012, the appellant did not file an appeal of the probate court's entry. Instead, the appellant filed a motion for correction or modification of the record provided to the Sixth District as to the appellant's prior appeals. The appellant also requested a transcript from a hearing held before the probate court on January 28, 2008 because the appellant believed that the transcript would prove that the probate court erred in refusing to transfer the ward's real property to the appellant. When the probate court denied the appellant's motion to correct the record, the appellant appealed. Because the appellant did not file a notice of appeal challenging the probate court's May 30, 2012 entry, the appellate court found that January 28, 2008 hearing was not part of the record. Additionally, the appellate court found that an appeal was the inappropriate avenue to obtain the transcript. The appellant should have pursued the denial of his public-records request under R.C. § 149.43 through a mandamus action.
